The US Government's Position on FOCI

Updated: Nov 2, 2021

Foreign investment plays an important role in the U.S. industrial base and is allowed - if it aligns with the national security interests of the US. Companies with a foreign minority position greater than 5% of the ownership interests, greater than 10% of the voting interest OR any ownership by a foreign government fall under FOCI and requires mitigation.
